AUTHORISATIONS PURSUANT TO ART.16 PORT OPERATIONS AND SERVICES PURSUANT TO LAW 84 OF 28 JANUARY 1994

PORT OPERATIONS AND SERVICES

In order to carry out port operations and port services as per art. 16 of Law 84/94, prior authorisation to be issued by the Entity is required. The activity in question is governed, in general, by Ministerial Decree no. 585 of 31 March 1995 (pdf - 43.42 Kb ).

PORT OPERATIONS

In order to obtain the authorisation to carry out port operations, as per art. 16 of Law 84/94, the applicant company must produce an application on legal paper and demonstrate that it meets the requirements of Ministerial Decree. 585 of 31 March 1995

Port operations include the loading, unloading, transhipment, storage and movement in general of goods and any other material, carried out within the port.

The following is a list of the documentation required to file an application:

Release

 -Application (doc - 36.5 Kb ) on Company letterhead paper with affixed stamp of € 16.00;

 -Corporate self-certification (doc - 61.5 Kb ) on the company letterhead paper, date stamped and signed by the legal representative, accompanied by an identity document;

 -Port operations form (pdf - 280.12 Kb );

 -Anti-Mafia declaration (pdf - 212.27 Kb ) (D.P.R. n.445 of 28.12.2000) issued by the obliged parties, accompanied by a copy of the subscribers’ identity documents;

 -Declaration in lieu of duly completed certifications  (doc - 28.5 Kb ) regarding pending loads, criminal records of all persons holding corporate offices and appearing in the Chamber of Commerce, accompanied by the declarant’s identity document;

 -Organisational capacity to acquire technological innovations and new operational methods for better efficiency and quality of services;

 - Financial capacity, certified by the presentation of financial statements for the previous two years;

 - Tariff for the year relating to the request for authorisation;

 - Presentation of an operational programme of no less than one year with an investment plan, potentially broken down into estimated costs and traffic prospects;

 - Presentation of an insurance contract that guarantees persons and property against any damages deriving from the performance of port operations for which authorisation has been requested (maximum of no less than € 2,600,000, revalued annually according to ISTAT indices);

 - Employee organisation chart, including management, necessary for carrying out the planned activities;

 - List of the means necessary for carrying out the planned activities, owned, leased or hired for a period of no less than one year and the relative insurance policies, registration number and/or serial number and any company identification number.

Any variation in the fleet of operating vehicles must be communicated to the System Authority, which reserves the right to evaluate this authorisation.

 - Certificates of incorporation and articles of association, filed with the Commercial Registry of the competent Civil Court as certified copies. For companies set up as cooperatives, in addition to the documentation indicated above, registration in the Prefectural Register of Cooperatives or in the General Register of Cooperatives is required. (Article 7(2)(b)(2) of the Regulation referred to above).

 - The Company is required to pay a security deposit to guarantee the obligations undertaken in connection with the authorisation to carry out the following port operations, pursuant to Article 16 of Law 84/94. Mandatory clauses Fidejussionary Policy (doc - 38.5 Kb ).

 -Form I (pdf - 691.03 Kb ) - Registration form for the training course on risks related to work in the Port for each worker involved in the operations;

 -Privacy policy Form (pdf - 123.7 Kb ) completed by each employee referred to above together with the identity document;

Any change in operating staff must be communicated to the System Authority, which reserves the right to evaluate this authorisation.

 The requests instructed by the competent offices are submitted to the Management Committee in accordance with the provisions of Articles 8 and 9 of Law 84/94.

Renewal

 -Application (doc - 35.5 Kb ) on Company letterhead paper with affixed stamp of € 16.00;

 -Corporate self-certification (doc - 61.5 Kb ) on company letterhead paper, date stamped and signed by the legal representative, accompanied by an identity document;

 -Port operations form (pdf - 280.12 Kb );

 -Anti-Mafia declaration (pdf - 212.27 Kb ) (D.P.R. n.445 of 28.12.2000) issued by the obliged parties, accompanied by a copy of the subscribers’ identity documents;

 -Declaration in lieu of duly completed certifications (doc - 28.5 Kb ) regarding pending loads, criminal records of all persons holding corporate offices and appearing in the Chamber of Commerce, accompanied by the declarant’s identity document;

 -Organisational capacity to acquire technological innovations and new operational methods for better efficiency and quality of services;

 - Financial capacity, certified by the presentation of financial statements for the previous two years;

 - Tariff for the year relating to the request for renewal of authorisation;

 - Presentation of an operational programme of no less than one year with an investment plan, possibly broken down into estimated costs and traffic prospects;

 - Presentation of an insurance contract that guarantees persons and property against any damages deriving from the performance of port operations for which authorisation has been requested (maximum of no less than € 2,600,000, revalued annually according to ISTAT indices);

PORT SERVICES

 In order to obtain the authorisation to carry out port services, as per art. 16 of law 84/94, the applicant will have to produce an application on legal paper and prove that he/she meets the requirements of the APG Regulation no. 1678 of 12 December 2002 (pdf - 493.1 Kb ).

 Port Services are those related to specialised, complementary and ancillary services to the cycle of Port Operations.

 The following is a list of the documentation required to file an application:
