It investigates administrative procedures relating to authorisations to carry out Port Operations and Services (Article 16 of Law no. 84 dated 28 January 1994 and subsequent amendments and additions) that are not the responsibility of the State Governance Staff, Company Plans and Subsidiaries.

It participates in the processing of the regulations governing the Shipyard of the Port of Genoa, as well as those relating to the conduct of commercial activities in the port area.

It investigates requests for renewal and/or issuance of authorisations for said activities (entry in the Register pursuant to Article 68 of the Italian Navigation Code, Business Licences and Provisional Authorisations).

It is responsible for the acquisition of data useful for the compilation of Compulsory Registers from all parties authorised to carry out port operations and services (Article 16 of Law no. 84/1994) and port work (Article 17 of Law no. 84/1994).

It maintains the Register of Chemical Consultants of the Port and the related verification requirements.

It ensures the collection and publication, by decree, of the rates charged to port users.

Authorisations for the SHIPBUILDING sector - Regulation approved by AGP Decree no.711 of 11 June 2007

COMPANY CERTIFICATION

In order to obtain the issuance of the authorisations to carry out the shipbuilding activity, the applicant shall have to produce an application on legal paper and demonstrate the possession of the requirements provided for by GPA Decree no. 711 dated 11 June 2007 (pdf - 570.36 Kb ).
The Regulation applies to all works involving construction, preparation, conversion, repair, demolition and specialists on board ships and pleasure boats, as per Law no. 171 dated 18 July 2005 and subsequent amendments, and on floating bodies in general in the Port of Genoa, with the exception of pleasure boats. (Title 1, Article 1 Scope).

Below is a list of the documentation required for filing an application for the following purposes:

RELEASE
- Application (doc - 33 Kb ) by the Company with an affixed stamp for €16.00 drawn up on letterheaded paper, dated, stamped and signed by the legal representative with an attached copy of a valid identity document stating the specific category for which the issuance is requested (Article 5 of Regulation no. 711/2007);
- Declaration of turnover (doc - 39 Kb ) and related documentation proving that, in the 24 months prior to the application, the company's main activity has been conducted in the Port of Genoa and refers to the activities governed by the applicable Regulation; - Documentation proving that the company has acquired, directly from the shipping companies, work orders carried out in the Port of Genoa under provisional authorisation, which must be no less than 6 in the 24 months prior to the request for a workload of which the total turnover is not less than €200,000.00;
- Certified copy of the Memorandum of Association and Articles of Association, filed with the Commercial Registry of the competent Civil Court. (Attention: in the case of companies incorporated in cooperative form, please produce a copy of the registration in the Prefectural Register of Cooperatives or in the General Register of Cooperatives);
- Corporate self-certification (doc - 82 Kb )concerning the company's data, filled in on the Company's letterheaded paper, dated and signed by its legal representative;
- Anti-mafia declaration of those responsible specified in the table, dated and signed, accompanied by a valid copy of the identity documents of the subscribers or, alternatively, listing on the so-called "white list" of the Prefecture.
- Copy of the Chamber of Commerce Register

Below is a list of the documentation required for filing an application for the following purposes:

RENEWAL
- Application (doc - 30 Kb ) of the Company with an affixed stamp for €16.00, drawn up on letterhead paper, dated, stamped and signed by the legal representative with an attached copy of a valid identity document stating the specific category for which the renewal is requested (Article 5 of Regulation no. 711/2007);
- Corporate self-certification (doc - 82 Kb ) concerning the company's data, filled in on the Company's letterheaded paper, dated and signed by its legal representative;
- Statement of turnover (pdf - 212.27 Kb ) made during the year for the year of reference for authorised activities relating to orders placed on board ships in the Port of Genoa;
- Anti-mafia declaration of those responsible specified in the table, dated and signed, accompanied by a valid copy of the identity documents of the subscribers or, alternatively, listing on the so-called "white list" of the Prefecture;
- Copy of the Chamber of Commerce Register

PROVISIONAL AUTHORISATION

GPA Decree no. 711 dated 11 June 2007 (pdf - 570.36 Kb ) approves the Regulations for the Shipbuilding Industry of the Port of Genoa.
Provisional Authorisations may be granted for the execution of work to be carried out on board the ship to applicants not holding a Business Licence, with a validity limited to the duration of the work on board the ship and, in any case, no longer than the maximum duration of one month; said validity may be renewable.

For the issuance of the Provisional Authorisation, below is a list of the documents to be submitted and the forms to be used, the completion of which must be computerised:

Issuance:

  • Application of the Company complete with stamp for €16.00, dated no later than the date of submission of the application drawn up on letterheaded paper, dated, stamped and signed by the legal representative;
  • Corporate self-certification on letterheaded paper;
  • Form B - Request for valid permits for access to the Port for companies;
  • Form C - List of staff and vehicles;
  • Contract or work order assigned by the Shipowner or Supplier of the order to be carried out on board the ship.

If maintenance, repair and conversion work is carried out by more than one company, the security document (DVR - Risk Assessment Document, for its acronym in Italian) must be submitted in accordance with Article 38 of Legislative Decree. No. 272/1999.

In the case of Firms working under a subcontract, a letter of authorisation from the Shipowner or the Contractor must be produced, authorising the Contracting Firms to entrust part of the work to another Company.

In the case of foreign companies,Form A1 must also be produced, concerning the certificate for the posting of workers to EU countries, for each worker specified in Form C, as well as the duly completed "Company Personal Data" form.

No Provisional Authorisations shall be issued to Companies or Enterprises that have not been registered with the Chamber of Commerce for at least 12 months.

At the time of issuance of the Provisional Authorisation, the Company is required to pay a fee for each month, or a fraction thereof, for the duration of work on board the ship for which the authorisation was issued, plus €16.00 of stamp duty paid using the virtual method by the Authority on the document issuing said authorisation, plus €2.00 for an invoice revenue stamp.

This shall be followed by the transmission of the relevant collection notice by the Entity's competent Accounts Department.

In the event of failure to withdraw the authorisation, the Company shall not be able to obtain permission to access the Port of Genoa and, consequently, the permission to board the ship, and the Western Ligurian Sea Port System Authority may proceed to revoke/suspend the authorisation.

In the case of renewal of a previously granted Provisional Authorisation - necessarily before the expiry thereof - the Company must submit the following:

  • Application for renewal on the Company's letterheaded paper;
  • Form B - Request for valid permits for access to the Port for companies;
  • Form C - List of staff and vehicles;

In the case of foreign companies, Form A1 must be produced, concerning the certificate for the posting of workers to EU countries, for each employee who shall have to work on board a ship or for each worker specified in Form C.

The Renewal shall involve the same costs and the same payment procedure as the issuance of the Provisional Authorisation, excluding stamp duty of €16.00.
